Landlord / Tenant

Rose & Rose represents property owners in all five boroughs and the surrounding metropolitan area, including Nassau, Suffolk and Westchester. Our clients benefit from our attorneys’ in-depth knowledge of the housing laws and regulations throughout the City and State, whether in representing a landlord in a simple nonpayment case, a complicated holdover proceeding, or in defending a tenant’s counterclaims. We understand the value to our clients of getting their cases to court promptly and swift resolution of their cases whenever possible. We counsel our clients on all options. When a settlement is not possible or advisable, we will aggressively pursue the best possible result at trial. Our staff will monitor your case and notify you of tenant deadlines in settlement agreements so that there is no delay in your getting the benefit of a settlement or court order.

Leasing

Our firm represents clients in connection with the leasing of commercial space of all types. Services we can provide include preparation of new leases, lease extensions, amendments, assignments and various other agreements related to commercial leases and tenancy issues and disputes. Our extensive experience with commercial landlord/tenant litigation benefits our clients in our preparation of leases, related documents and agreements. We can also review existing leases for purposes of due diligence and/or to provide analysis and advice to meet clients’ needs. While we primarily represent landlords, we also provide service to clients who find themselves in the position of tenant.

Appellate Practice

Our attorneys handle every aspect of prosecuting and defending appeals and motions in the Appellate Term and Appellate Division of the First and Second Departments. We understand the cost involved when a client is considering an appeal and provide counsel on the merits of an appeal and the cost to the client. When an appeal is pursued, we have experienced counsel who prepare and review the record on appeal, who write the appellate brief, and who argue the appeal.

Condominium / Co-op

Rose & Rose provides legal services to cooperative and condominium projects encompassing from less than ten to several hundred units–as well as to their sponsors and residents. Our attorneys understand concerns unique to the cooperative and condominium experiences and their volunteer boards. Rose & Rose serves as general counsel to boards and to their managing agents with regard to routine business, corporate governance, third party contracts, management, employment and regulatory matters and building operations. Rose & Rose also serves as litigation counsel in city, state and federal courts and before administrative agencies in connection with claims concerning the ownership or nonconforming use of individual units or breaches of proprietary leases or by-laws; disputes with sponsors, unit owners, vendors, contractors and professional or commercial tenants; contractor, vendor and adjoining building issues; labor, wage and discrimination claims; and maintenance and common charge claims.

Rose & Rose provides due diligence reports, analysis, opinion letters and general transactional support in connection with purchases, sales, refinances and operation of multifamily properties in New York City.
